This is an admiralty case, which was instituted by Karis Premeaux, hereinafter referred to as the seaman, against Socony-Vacuum Oil Company, Inc., respondent, on two counts, (1) for cost of maintenance and cure, and (2), under the Jones Act (41 Stat. 1007, sec. 33, 46 USCA, sec. 688), for damages resulting from respondent’s negligent failure to furnish him adequate maintenance and cure after it learned that he had become ill of tuberculosis at sea in the service of resepondent’s ship.
