This matter comes before the Court on two motions: Defendant International Brotherhood of Electrical Workers Local 345 (“Union”) Motion for Summary Judgment (Doc. 17), and Plaintiff Alabama Power Company’s (“APCo”) Motion for Summary Judgment (Doc. 20). This is an action, instituted by Plaintiff APCo, to vacate an arbitration award sustaining a grievance filed by Defendant pursuant to grievance-arbitration procedures of a Collective Bargaining Agreement (“CBA”) in effect between APCo and the Union.
