Upon a trial before a police magistrate in McHenry ..county, the plaintiff in error, George J. Sayer, was found guilty of unlawfully hunting with a gun on the lands of Charles C. Colby without first obtaining permission so to do and was fined $10 and costs. Upon appeal to the circuit court of said county, a jury having been waived, the cause was tried by the court, and the defendant submitted the following proposition to be held as the law: “The court holds, as a matter of law, that section 28 of chapter 61 of the Revised Statutes of the State of Illinois is unconstitutional and void.” The…
