Plaintiff in error Felix Arthur Martin, defendant below, was charged by information in the county court of Pittsburg county, Oklahoma, with the offense of driving his automobile on July 1, 1948, on the public highway near Krebs, Pittsburg county, Oklahoma, while under the influence of intoxicating liquor, in violation of Title 47, § 93, 0. S. A. 1941.
The defendant was tried by a jury, convicted, his punishment fixed at $100 fine and judgment and sentence entered accordingly. From said judgment and sentence this appeal has been perfected.
