Defendant, Dick Passmore, was charged in the county court of Rogers county with the offense of having unlawful possession of intoxicating liquor, to-wit: nine pints of whisky; was tried, convicted and sentenced to pay a fine of $500 and to serve 30 days in the county jail, and has appealed.

The assignments of error will be considered in their order.
