MEMORANDUM AND ORDER-.DENYING DEFENDANT’S MOTION TO DISMISS FOR LACK OF PERSONAL JURISDICTION AND DENYING THE DEFENDANT’S MOTION TO TRANSFER VENUE.

The defendant in this diversity contract dispute, Tougher Industries, Inc., (“Tougher”) moves to dismiss plaintiff Mid-West Materials, Inc’s. (“Mid-West”) action for lack of personal jurisdiction, pursuant to Fed.R.Civ.P. 12(b)(2) or, in the alternative, to transfer venue, pursuant to 28 U.S.C. § 1404(a). (Doc. 5).
