This case comes before the court on plaintiff’s motion, filed May 24, 1974, moving that the court adopt, as the basis for its judgment in this case, the recommended decision of Trial Judge Philip E. Miller, filed February 20,1974, pursuant to Eule 134(h), defendant having failed to file a notice of intention to except thereto and the time for so filing pursuant to the Eules of the court having expired.
