Virgil Merritt was placed on trial in the superior court of Carroll county, on an indictment charging him and Avery Merritt with the offense of assault with intent to rape. The defendant was found guilty, and excepts to the judgment overruling his motion for new trial. It appears from the record that Mary White, the female alleged to have been assaulted, was about twenty years of age. Among the witnesses introduced by the State was her father.
