WUEST, Chief Justice.
Bankwest, Inc., (Bank), brought an action against Laverne Valentine (Laverne) seeking payment of a promissory note executed in favor of the Bank by Laverne’s son, Bob Valentine (Bob), and co-signed by Laverne. Laverne raised several affirmative defenses in this action and also submitted a counterclaim against the Bank seeking damages on the grounds of deceit. This case was submitted to a jury which returned a verdict in favor of Laverne on the Bank’s claim, and in favor of the Bank on Laverne’s counterclaim.
