Appeal from an order of the Supreme Court (Aulisi, J.), entered July 15, 2008 in Fulton County, which, among other things, granted the motions of defendants Village of Northville and Town of Northhampton for summary judgment dismissing the complaint against them.
The Department of Environmental Conservation notified plaintiff in 2002 that property he owned in the Village of Northville, Fulton County was contaminating surrounding ground water and in need of remedial measures.
