Appeal from Circuit Court of Russell. Tried before Hon. J. E. Cobb. The appellant, O. A. FieLds, was indicted for the murder of Jesse Dumas. He was tried at the Fall term, 1872, convicted of murder in the second degree, and sentenced to ten years’ imprisonment in the penitentiary. On his appeal, this court reversed the judgment and sentence, and remanded the case for a new trial.

The statute of December 11, 1874 (Paanph.
