— Appeal (1) from an order of the Supreme Court at Special Term, entered August 25, 1977 in Fulton County, which granted plaintiffs motion to strike defendants’ answer and granted plaintiffs motion for summary judgment, and (2) from the judgment entered thereon. On May 9, 1966, William and Thomas Fioravanti purchased a house and lot located in the Town of Caroga, Fulton County. At *1012that time, they executed their bond for the payment of $2,500 with interest to plaintiff, payable in monthly installments of $27.76.
