Plaintiff and debtor Ellison Associates (hereinafter “Ellison”) appeals from an order of the Honorable Burton R. Lifland, Bankruptcy Judge; which granted defendants Eastwood Management Corp. (hereinafter “Eastwood”), Bowery Savings Bank (hereinafter “Bowery”), and Harris, Beach, Wilcox, Rubin & Levey’s (hereinafter “Harris, Beach”) motion for summary judgment and dismissed plaintiffs adversary proceeding and Chapter 11 petition.
