Mitchell, J.—

These two cases, consolidated for trial and appeal, were brought against Louis Nockas to recover for personal injuries received by the plaintiffs in an automobile accident.

One action was brought by Louis Alexiou and his wife and their minor child, by his guardian ad litem. The other action was brought by John Baptis. The jury brought in a verdict in each case for the defendant. A new trial was granted, in general terms, in favor of the child, John Alexiou, from which no appeal has been taken.
