OPINION AND ORDER
CEREZO, District Judge.
This is an action for declaratory and monetary relief based on an arrest, search, seizure, and subsequent criminal prosecution which plaintiffs claim violated their constitutional rights. Jurisdiction is premised on determination of the federal constitutional rights underlying the claim, 28 U.S.C. Sec. 1331, as enforced by the Civil Rights Act, 42 U.S.C. Secs. 1981,1983,1985,1986 and 1988. Dismissal has been requested by defendants 1 on the ground that the action is time barred.
