DEVANY, Justice.
Heriberto Balderas Cortez appeals his conviction for murder. The case was tried before a jury and appellant was sentenced to life confinement in the Texas Department of Corrections and a $10,000 fine. In two points of error, appellant contends that (1) the trial court erred in failing to include the instruction on parole required by TEX. CODE CRIM.PROC.ANN. art. 37.07 § 4(a); and (2) the trial court erred in not granting appellant’s motion for mistrial on the basis of newly discovered evidence offered prior to the jury’s verdict on punishment.
