In an action to recover damages for personal injuries and wrongful death, etc., based upon medical malpractice, the defendant appeals from a judgment of the Supreme Court, Kings County (Steinhardt, J.), entered November 13, 2003, which, upon a jury verdict apportioning the defendant’s decedent, Richard A.
