MEMORANDUM

LASKER, District Judge.

This is a motion for an order dismissing the complaint herein for a lack of jurisdiction over the subject matter pursuant to Rule 12(b) (1) of the Federal Rules of Civil Procedure.

In this action on a promissory note, the court’s jurisdiction is predicated on the diversity of citizenship provisions of 28 U.S.C. § 1332(a) (1). The complaint, which was served on May 8, 1969, alleges that plaintiff is a “resident, citizen, and inhabitant of the Commonwealth of Massachusetts,” and that defendant is a “resident of the State of New York.” Plaintiff admits that the…
