In this diversity action, the Kroger Company (hereafter Kroger) seeks indemnification for amounts expended in settling personal injury claims of various consumers who purchased allegedly deleterious “smoked white fish chubs” at certain Kroger retail stores in Kentucky, Tennessee, and Alabama.
