MEMORANDUM OPINION AND ORDER

MAHONEY, United States Magistrate Judge.

Before the court are two motions regarding a letter rogatory request, issued by the Local Court of Ludwigsburg, Germany. The letter rogatory seeks judicial assistance from the United States in obtaining a blood sample from a United States citizen, one Antone Smith. The United States has filed a Motion For An Order Requiring A Blood Sample and Mr. Smith has filed a Motion To Dismiss this action.
