Qi Cui v. Mukasey
Court of Appeals for the Ninth Circuit
1Opinion of the Court
PREGERSON, Circuit Judge:
Qi Cui (“Cui”), a native and citizen of China, petitions for review of a final order by the Board of Immigration Appeals (“BIA”) affirming Immigration Judge (“IJ”) Thomas Y.K. Fong’s ruling that pre-termitted Cui’s application for withholding of removal and relief under the Convention Against Torture (“CAT”). We must decide whether the IJ abused his discretion in refusing to grant Cui’s motion for a continuance so that she could resubmit fingerprints for a background security check. We have jurisdiction under 8 U.S.C. § 1252, and we grant relief and remand.
