The United States appeals from the August 9, 1991 decision by the United States Claims Court, 1 Appalachian Regional Healthcare, Inc. v. United States, No. 205-88C (Cl.Ct. Aug. 9, 1991), denying the United States’ motion to dismiss Appalachian Regional Healthcare, Inc.’s (ARH’s) complaint for lack of jurisdiction. The Claims Court found this case indistinguishable from Mount Sinai Medical Center of Greater Miami, Inc. v. United States, 23 Cl.Ct. 691 (1991), which decided the court had jurisdiction under the same circumstances as in this case. Because we conclude that the…
