THIS CAUSE comes before the Court on motions to dismiss for failure to state a claim, or, in the alternative, for summary judgment by Defendant Don Mealy Imports, Inc., d/b/a Courtesy Acura (“Courtesy”) (Doc. 16, filed 11 August 2003) and Defendant Liberty Mutual Insurance Company (“Liberty Mutual”) (Doc. 18, filed 11 August 2003), to which Plaintiff Donald A.
