GODDARD, District Judge.
This matter comes before the court on a motion made by defendant to set aside a directed verdict in favor of the plaintiff on January 2, 1935, for $18,-600, the amount of cash paid out by the police property clerk of the city of New York in disregard of plaintiff’s demand and warrant of distraint. This $18,600 in currency was taken from the person of Arthur Flegenheimer, alias “Dutch Schultz,” at the time of his arrest by police officers of the city of New York on June 18, 1931.
