The circuit court of Jackson county confirmed the award of the Industrial Commission on the claim of defendant in error, Robert Miller, for injuries received in the course of his employment as a mechanic in the garage of plaintiff in error at Carbondale on September 8, 1925. The circumstances surrounding the injury are not in dispute, nor is it disputed that the plaintiff in error and Miller are under the Workmen’s Compensation act and that the injury occurred while Miller was employed by the plaintiff in error.
