Plaintiffs-Appellants Stephen Farmer, et al., filed a civil suit against Defendants-Appellees D & 0 Contractors, et al., alleging violations of the Racketeer Influenced and Corrupt Organizations Act (RICO). Defendants-Appellees moved to dismiss the RICO claims as time barred, which the district court treated as motions for summary judgment. The district court granted the motions for summary judgment and dismissed Plaintiffs’ claims with prejudice.
