Appeal from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered December 6, 2005. The order granted defendants’ motion to vacate the note of issue and cer*1282tificate of readiness for trial and denied without prejudice plaintiffs’ motion for summary judgment or, in the alternative, for partial summary judgment on liability.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
