OPINION

ROBINSON, Judge.

This case is before the court on defendant’s motion to dismiss or, in the alternative, for summary judgment, and on plaintiff’s cross-motion for summary judgment. Plaintiff seeks compensatory and injunctive relief under Title 37 of the United States Code, entitled “Pay and Allowances of the Uniformed Services.” 37 U.S.C. §§ 101 et seq. This court’s jurisdiction arises under 28 U.S.C. § 1491 (1982).
