The plaintiff in error, hereinafter called defendant, was convicted in the district court of Muskogee county on a charge of resisting an officer, and his punishment was fixed at a fine of $250.
Defendant interposed a plea of former jeopardy. The court refused to hear any evidence on the plea, and summarily overruled it. The only contention made here is that the plea of former jeopardy constituted a complete defense and that the court erred in rejecting it.
