The plaintiff in error, hereinafter called the defendant, was convicted in the district court of Love county of the crime of grand larceny, and sentenced to imprisonment in the state penitentiary for a term of six months. Motion for new trial was filed and overruled, and defendant excepted, and has appealed to this court.
