Following a bench trial in the circuit court of Henry County, the defendant, Leonard Weir, was convicted of two counts each of unlawful use of weapons and aggravated assault, and he was sentenced to prison and fined. The appellate court reversed the convictions and remanded the cause for a new trial, concluding that counsel’s failure to present a defense of voluntary intoxication had denied the defendant the effective assistance of counsel.
