James L. Kapsis (“plaintiff’) commenced this action, on behalf of himself and a class of individuals similarly situated, against American Home Mortgage Servicing Inc. (“AHMSI”) and Argent Mortgage Company, LLC (“Argent”). Plaintiff alleged that AHMSI violated the Fair Debt Collection Practices Act (“FDCPA”), 15' U.S.C. § 1692 et seq., the Real Estate Settlement Procedures Act (“RESPA”), 12 U.S.C. § 2601 et seq., and New York General Business Law § 349 (“Section 349”).
