This action was brought to recover damages for personal injuries alleged to have been sustained by plaintiff by reason of defendant's negligence in allowing the walls of a trench in which plaintiff was working to fall upon him. The jury returned a verdict in favor of the plaintiff, on which judgment was duly entered. The court denied the motion of the defendant for a new trial, and this appeal is from the •judgment and order denying said motion.
