This is an action upon a policy of insurance issued by the Northwestern National Insurance Company of Milwaukee, Wisconsin, to appel*88lee, plaintiff below, insuring Mm in the sum of $1,500 against loss or damage by fire.or theft of an automobile in consideration of certain warranties and the payment of a premium of $48.75. From a judgment in favor of appellee for $1,150 principal, fifteen per cent penalty thereon, attorney’s fees and costs, and a denial of its motion for a new trial, defendant appeals.
