Oates and Sarah R. *598Oates, who were husband and wife, on December 15, 1892, made and delivered their promissory note for $355 to the Seattle Savings Bank of Seattle; that on the same day said R. 0. Oates, in order to secure the payment of said note, executed and delivered a mortgage on lots Y and 8 in block 3Y, Mercer’s Second Addition to Forth Seattle, to the said bank.
