Appellee East Rio Hondo Water Supply Corporation (East Rio Hondo) filed suit against appellant Melden & Hunt, Inc. (Melden) and other defendants alleging breach of contract, breach of express and implied warranty, negligence, negligence per se, and negligent misrepresentation in connection with the design and construction of a water treatment plant 1 .
