This is an appeal from an order granting, in part, plaintiffs’ motion for a new trial after judgment of nonsuit had been entered in favor of defendant.

Plaintiffs alleged that defendant insurance company insured decedent Almon Clark Spencer, quoting from the complaint, “among other things, against sickness, and agreed, in the event of any such sickness, to pay to said decedent or his therein named beneficiaries, Emma J.
