The pleadings are similar to those in the case of Andrews v. the same appellees, at this term (1).

Numerous points are presented for our consideration .by *175the brief of the appellant. Such points, from the fourth to the fourteenth inclusive, have been considered in the case of Andrews, heretofore cited.
