Memorandum Opinion and Order

Carman, Chief Judge:

Defendant moves this Court pursuant to U.S. CIT R. 68 for an award of attorney’s fees and other expenses under the Equal Access to Justice Act, 28 U.S.C. § 2412 (1988), as well as for costs pursuant to 28 U.S.C. § 1920 (1988). Defendant asserts it is entitled to an award of attorney’s fees and costs because it was the prevailing party in this matter, see United States v. Ziegler Bolt and Parts Company, 883 F.
