This is an appeal from an order of the trial court granting a motion for judgment notwithstanding the verdict.

On August 7, 1966, appellant, Joseph R. Gondek, and respondent, Pow-Bel Construction Corporation, signed a purchase agreement for certain real estate in St. Louis Park, Minnesota. As part of the agreement, respondent seller agreed to “pay all existing special assessments and all closing costs for this transaction.” A mortgage commitment was obtained from Farmers and Mechanics Savings Bank.
