Plaintiff has attempted to commence an action in New York State against a Florida corporation by the service of a summons in New York City on one Abraham Plotsker, who is a member of a partnership doing business in New York City as Broadway Resort Service. Defendant, Surf Properties, Inc., operates under the name of Belmar Hotel of Miami Beach. Appearing specially, defendant moved to vacate this service of process.
