Garland C. Cook, a millwright employed by Westinghouse Electric Corporation (Westinghouse), was injured while working at a nuclear power plant owned and operated by Nebraska Public Power District (NPPD). Cook received workers’ compensation from Westinghouse, then sued NPPD, alleging its negligence had contributed to his injuries. NPPD filed a cross-claim against Westinghouse, seeking contractual indemnification for defending against Cook’s lawsuit.
