I. FACTS

Donald Johnson was a field auditor for the Minnesota Department of Economic Security. In May of 1976, Johnson informed his supervisor that he was considering becoming a candidate for the Minnesota House of Representatives. His supervisor responded to plaintiff in a memo stating that a leave of absence to run for political office could not be granted.
