Complaint for land. Before Judge Park. Jones superior court. September 3, 1920. In his will executed in 1859, and probated in solemn form in June, 1865, Thomas W. Choate devised some 1600 acres of farm or agricultural lands, situated in Jones county, to his daughter, Mrs. Mary C. Pitts, during her life, and at her death “ to go to and be vested in her child, children, or representatives of children, if any, surviving her.”

1. Section 1779 of the Civil Code, which went into effect on January 1, 1863, declared: “All sales of any portion of the property of the ward shall be made under the direction of the ordinary, and under the same rules and restrictions as are prescribed for sales by administrators of estates.” The same language was contained in the Codes of 1868, 1873, and 1882.
