Plaintiffs Drakes Bay Oyster Company (the “Company”) and Kevin Lunny (“Lunny” and collectively, “Plaintiffs”) initiated this action requesting that the Court declare void and unlawful the November 29, 2012 Memorandum of Decision of Defendant Kenneth L. Salazar, Secretary of the U.S. Department of the Interior (“Secretary”), in which he decided not to grant Plaintiffs a permit to allow for the continued operation of their oyster farm (“Decision”).
