Appeal Tby plaintiff from an order denying Ms motion for a new trial.

Defendants Byers, Miller, Heins and Nelson are hereinafter referred to as the defendants.

Plaintiff, Edward Snicker, is an incompetent person and under guardianship in the probate court of Renville county. He served in the World War and had compensation for disability coming to him from the federal government. Compensation ivas paid, first a sum for accrued compensation and thereafter in monthly payments. His guardian collected the compensation and deposited same in banks in his name as guardian.
