MEMORANDUM OF DECISION AND ORDER ON DEFENDANTS’ MOTION TO DISMISS
STEARNS, District Judge.
This matter is before the court on a motion to dismiss a Petition for Exoneration From or Limitation of Liability, Civil and Maritime (“Petition”). The defendants, co-administrators and beneficiaries of the estate of the decedent, Kay Jennette, brought a wrongful death action against the plaintiff, Anthony Keller, in Worcester Superior Court, after Keller filed the Petition in this court seeking to limit his liability for Kay Jennette’s death to the value of his vessel.
