Appellant Leo Vartanian (“Vartanian”) brought claims against his former employer, Appellee Monsanto Chemical Company (“Monsanto”), under the Employment Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq., pursuant to Section 502(a) of ERISA, 29 U.S.C. 1132(a), as well as under common law, 1 asserting that Monsanto breached its fiduciary duty and engaged in unlawful discrimination and misrepresentation.
