Error to Bay; Sharpe, J., presiding. Replevin in justice’s court by Peter La France against Delia Cullen. There was judgment for plaintiff, and defendant appealed to the circuit court. Judgment for defendant. Plaintiff brings error.

The plaintiff brought an action of *727replevin, in the justice’s court to recover a buffet from the defendant. In that court he was successful in his contention, and on appeal to the circuit court, where the case was tried before a jury, a verdict was rendered for the defendant, and the property ordered returned.

The plaintiff is the proprietor of a furniture store in the city of' Bay City, Mich., and on November 14, 1912, entered into a contract with the defendant whereby the defendant purchased the buffet under a lease or installment contract for the sum of $37. Five dollars was paid down at…
