STEPHENS, Justice.

The issue we decide on this appeal is whether that part of KRS 78.428 which provides that in counties containing a population of 600,000 or more, all officers of the *415county police force above the rank of captain are excluded from the county police merit system, is unconstitutional as being special or local legislation in violation of Sections 59 and 60 of the Kentucky Constitution.
